Tax Sale Information
The Chancery Court Clerk & Master’s Office is responsible for conducting public auctions for delinquent real estate property taxes in Shelby County for both City of Memphis and Shelby County back taxes. You must register to bid in these auctions before the sales commerce. We do not accept credit cards, personal checks or arrange financing. The winning bid must be tendered in cash, cashiers check or money order. Notes 1. When property taxes are delinquent and suit has been filed the Chancery Court Clerk and Master proceeds to sell the property for satisfaction of the delinquent tax lien or liens. TCA §67-5-2501. 2. The taxpayer or owner may pay the amount owed anytime before the sale and the lawsuit involving his/her property will be dismissed. 3. The opening bid at the auction is the total amount of delinquent taxes due on the property, plus the accrued penalties, interest, attorneys fees and court cost. 4. A potential purchaser is strongly urged to research the parcels offered for sale before the auction. 5. The successful bidder at a tax sale has 24 hours to pay the full bid amount in cash, cashiers check or money order, made payable to the Clerk & Master and delivered to the Chancery Court Clerk & Master’s office, 140 Adams Ave., Room 308, Memphis, TN 38103. The office hours are 8:a.m. through 4:30p.m. Monday through Friday. Note: The Clerk & Master will institute legal action against any purchaser who fails to comply with their bid. 6. The sale is not complete until a Chancellor signs an order confirming the sale. TCA §67-5-2419 7. After confirmation of sale, the purchaser may obtain a Clerk & Master’s Tax Sale Deed. The fee is $20.00. The deed should be recorded at the register’s office. 8. After the property is sold, the former owner, their heirs, lienholders, and assignees have a right to redeem or buy back the property within one year from the date of the sale. If redeemed the purchaser will be refunded the full purchase price plus 10% interest per annum. 9. Any questions about Chancery Court tax sales should be answered by our Bookkeeping Department.
