These are forms to be used in official business with the Shelby County Probate Court. Although some of these forms may be submitted by any citizen, as with any legal situation, consultation with an attorney should be considered.

Accountings Forms

 

Accounting Form
      This is the form (3 Pages) to be used for filing an
      accounting on an estate, guardianship, or
      conservatorship. In addition, these four (4) other forms
      are applicable.


  Affidavit for Waiving TN Inheritance Tax Return
       This is needed for estate accountings.

  Agreement Between Fiduciary & Financial Institution
       For reduction of fiduciary bond
  Appointment of Secretary of State
      Appointment of Secretary of State for Service of
      Process.


 

Certification as to Notice of Accounting
       
This form is to be filed by Attorney with each
      accounting of decedents estate.


 

Clerks Report on Accountings
      This cover sheet should be included with all accountings.

  Motion for Additional Time to File an Accounting
       This is required for an order of continuance on an
      accounting.
      (Attorney must present to Court)

  Notice of Accounting
      Notice of accounting.


 

Order Confirming Accounting
      This is the Order presented by the attorney to the
      Court to confirm an accounting.
      (Attorney must present to Court)


  Order Granting Additional Time to File an Accounting
       (Attorney must present to Court)

  Property Management Plan
      For Conservatorship and Guardianship accountings.
      Only needed if changed since last one filed.
  Statement as to Filing of USA or TN Income Tax Return
      For use with Conservator and guardianship accountings

  Statement From Corporate Surety
       This is needed for conservator and guardianship
      accountings.

  Statement of Fiduciary as to Physical or Mental
    Condition of the Disabled Person

      For Conservatorship accountings

       To be filed with Notice of Appeal

Certification of Property Management Plan (NEW)

Claim Form (NEW)
       This is to be used when filing a claim against an estate

Fiduciary Information Sheet
        To be filled out for the Personal Representative of each
       new case.

General Notice of Hearing
       This notice is the general, non-specific Notice of
       Hearing.


Information for Requesting a Name Change
         This form is to be used when requesting a name change.
 
Inventory Form
         This form is to be used when filling an inventory on
       
an estate. 

Inventory Form for Guardianship/Conservatorship
       This form is to be completed by the guardian or
       conservator when filing an inventory of assets and
       income.

Notice of Appeal  (NEW)
       Appeal Form to State Appellate Court

Notice of Hearing - Conservatorship
       This notice is to be served on all interested parties

Notice of Hearing - Ward
        This notice is for Conservatorships and is to be served
        on proposed ward.

Small Estate Affidavit (3 Pages)
         This is for opening an estate that is valued at less
         than $25,000.
